Why Florida residents are buying their CBD online

In the state of Florida, it’s far more convenient for most people to buy high grade CBD oil online instead of in brick-and-mortar stores. Florida’s confusing and emerging laws make online purchases a better choice until the laws and regulations have been updated. Until further notice, folks in Florida, and any other state with similar rules and regulations regarding Cannabidiol (CBD), can rely on online retailers without the need of a medical marijuana card. There’s little reason why Florida residents wouldn’t turn to purchasing their high-quality CBD-based oils online.

In Florida, people and medical patients are buying their CBD oil online without the hassle or potential embarrassment of buying from brick-and-mortar stores. According to FreshfromFlorida.com, hemp-derived therapeutic products or CBD, which contain 0% THC, are entirely legal to sell online to Florida residents. Though recently, the Florida Department of Agriculture and Consumer Services, FDACS, has said they are working with the Florida legislature to develop a regulatory plan in order to legally grow, process, manufacture, or sell CBD-based products containing up to the federally legal 0.3% THC.

What Is CBD oil?

Most people have heard about the trend of medical marijuana being legalized in many states. Both hemp and marijuana plants have many compounds that act to relieve pain and discomfort. While folks think hemp and marijuana are the same, due to being in same Cannabis Sativa family, they do provide different substances. Cannabidiol, also known as CBD, is the primary substance derived from hemp plants which is responsible for it’s plentiful therapeutic benefits. Tetrahydrocannabinol, short as THC, is the primary substance from the marijuana plant that generates a “high.” While only some states are legal to purchase and distribute marijuana, hemp-derived products were federally legalized by the 2018 Farm Bill.  With the proper extraction processes, one can get therapeutic relief through hemp derived products such as CBD, without the worry of the legalities and psychoactive effects, unlike of THC.

The legality confusion of CBD

As a result of the 2018 Farm Bill, the industry has been thrown into a state of chaos, though the legality of purchasing hemp-based products such as CBD in Florida is clear. There is a conflict between federal and state laws regarding hemp-derived products because it contains small amounts of THC, usually up to a measly 0.3%. In Florida, it is still illegal under state law to possess any products containing THC without a medical card.

According to an article at Forbes.com, hemp-derived products like CBD are legal to sell online, but marijuana products are not. There is also a confusing number of federal and state laws about medical marijuana, which has been legalized in many states including Florida. According to NCSL.org, 34 states and the District of Columbia, Puerto Rico, Guam and the Virgin Islands have approved some form of medical marijuana use.

Some states have legalized marijuana for recreational use, but the plant and its derivatives remain illegal under federal law. There are lots of new rules and regulations about transporting products across state lines, especially in regards to CBD. Last month, May 2019, The Transportation and Security Administration (TSA) recently loosened up their policies allowing CBD products to be carried in people’s travel bags. See the article here.

Due to the heavy confusion on the federal and state levels, more and more Florida residents turn to purchasing their CBD online. If you are a resident of Florida, you can buy high grade CBD online with little to no risk, and without the need of a medical marijuana card.

CBD oil in Florida can soon be found in traditional stores

More and more big retailers, such as Walmart, Walgreens and CVS are starting to offer topical CBD products for sale. Kroger recently approved a decision to sell CBD creams, balms, and oils at its stores in 17 states. However, CBD oil infused foods and snacks for ingestion remain illegal for retail sales until they can be approved by the FDA.

Carrying CBD products in Florida might pose risks

The confusing laws have created a free-for-all where every expert expresses a different opinion. You can buy high grade CBD oil online in Florida, but there might be risks if you carry it with you.

The Florida legislature recently passed Senate Bill 1020, which takes effect on July 1st 2019, legalizes the farming and cultivating of hemp plants in the state with the proper license. If you are a qualified medical marijuana patient, you can possess marijuana and hemp products under the F.S.S. 381.986- Medical Marijuana statute.

Cautionary tales about CBD products

Some people have been arrested for possessing legal hemp-derived products. In Florida, it’s a gamble to carry these products in public because you never know when you might run across the wrong enforcement agent. It’s likely that all these conflicts will eventually be addressed, but until then, the safest course is to buy CBD oil in Florida online. You should use these products in the privacy of your home until the laws have been clarified.

According to an article posted at Portlandmercury.com, a Florida resident was recently arrested at a checkpoint at Disney World. A CBD oil tincture was found by overly anxious security guards – not police – during a routine search.

The offender wasn’t misbehaving in any way or posing a threat to other park visitors. There was no evidence that she was under the influence of drugs or alcohol. However, the lady was arrested and spent 12 hours in jail for carrying an unknown drug. She was charged with possession of marijuana because the testing revealed that the oil contained 0.3 percent THC. Bail was set at $2,000.

Florida has a mix of retirees, conservatives and liberals, so you never know what to expect from a routine search. The lady in question, Hester Burkhalter, used the CBD oil tincture to treat arthritis pain in her shoulders, legs and arms. Until all the conflicting laws have been resolved, there is always a danger or carrying and using health products and dietary supplements based on cannabis or hemp in public.

Other potential issues in Florida that haven’t been resolved include dealing with U.S. Customs officials. Federal law is very clear: The federal Farm bill legalized carrying hemp-based products. However, customs officials often follow their own agency’s directives. According to federal law, possession of controlled substances at ports of entry into the United States can result in fines, penalties, seizures and arrest.

There are also risks of violating private regulations in Florida when using supplements. These risks include violating university policies, theme park regulations and others. The University of Miami’s Coral Gables campus recently issued a directive that banned the sale of CBD products on campus despite the fact that the products are perfectly legal under current Florida law.

If you have a legitimate medical marijuana card, MMC, then you can buy and possess marijuana-derived products according to the existing laws and regulations for Florida medical marijuana patients.

CBD-infused Products Provide Freedom of Choice

The statistics overwhelming show strong consumer support of the variety of CBD products that are available online. According to Statista.com, sales of CBD products will top $1.8 billion by 2022. Retailers like Kroger are taking note and selling these products where state regulations allow them to do so. Some of the products that are available online to Florida residents include:

  • Treats for injured pets
  • Edibles such as gummy bears, candies and ice cream
  • Skin lotions
  • Oils and tinctures
  • Soaps and bath salts
  • Coffee and tea
  • Vaping cartridges and oil

There are many choices for seniors and others suffering from different ailments, and Florida residents can choose how to use high grade CBD products in the privacy of their homes and offices. You can buy high grade CBD oil online and eliminate the risks of overzealous federal agents, security guards and conservative law enforcement officers who might not recognize recent changes in the law.
